TERMS AND CONDITIONS
This site is dedicated to the use by individuals and legal entities for information, respectively the purchase of products and services, sold / provided by CLINICA SRL, within the limits and with the application of the provisions contained in the “Conditions” below.
1. DEFINITIONS:
Clinica de Nutriție is the trade name of CLINICA SRL, a legal entity of Romanian nationality, having its registered office in Iași, Schitu Duca, having its registered office in Iași, Șos. Păcurari no. 70, bl. 550, ground floor, registered at the Trade Register Office under no. J22 / 526/2016, with CUI: 35726961.
SELLER is called CLINICA SRL.

ONLINE ADVICE PACKAGES : These are ADVICE medical services (online consultation, online nutrition advice packages) that are made available to the User at the web address
USER : means the natural or legal person who has or obtains access to the online consultation through the means of communication provided by the Nutrition Clinic and who purchases, for his or another person’s benefit (the Patient), Nutrition Consulting Packages .
BENEFICIARY or PATIENT : An individual who benefits from Order and payment for Health Care Packages for nutritional counseling and who will effectively use the nutrition services included in them.
ORDER : is an electronic document that acts as a form of communication between Seller and Customer through which Customer transmits Seller , through the Site intends to purchase Services from the Site (online) or directly from < strong> Seller (offline).
CONTRACT : represents the distance contract concluded between Seller and Customer / Participant / User , without the simultaneous physical presence of Seller and Customer / Participant / User .
2. AGREEMENT FOR THE USE OF NUTRITIONAL ADVISORY SERVICES
Nutritional counseling services may only be used in accordance with the provisions of this set of Terms and Conditions .
The provisions mentioned here constitute the contract (hereinafter referred to as the “Contract”) which governs the relationship between CLINICA SRL and any User . Please read this set of Terms and Conditions carefully.
Use of Services , including any functionality of the Nutrition Clinic , is a statement of compliance with the following conditions:
- REACHING THE AGE OF 18;
- NON-EXISTENCE OF CIRCUMSTANCES AFFECTING LEGAL CAPACITY,
- FULL ACCEPTANCE AND COMPLIANCE WITH ALL PROVISIONS OF THIS AGREEMENT, INCLUDING THOSE REGARDING LIMITATION OF LIABILITY Nutrition Clinic AND APPLICABLE LAW.
If any of these conditions are not met, User must immediately stop accessing or using Services .
In order to ensure compliance with the conditions of access and use of Services , User undertakes to verify at the time of each access to the clinicadenutritie.ro platform Terms and conditions to use the Nutrition Clinic . Use of Services , even in the event of User ’s failure to review Applicable Terms and Conditions , is the express consent of User acceptance of those conditions.
Without prejudice to the provisions of the above paragraphs, for the use of the Services, clinicadenutritie.ro may request the User to express his agreement to this contract by a specific action, which has the meaning of an unequivocal consent (e.g. ticking a specific box).
BY CHECKING THE BOX “I AGREE TO THE TERMS AND CONDITIONS OF THE NUTRITION CLINIC” USER EXPRESSLY AGREES TO FOLLOW ALL CLAUSES OF THIS AGREEMENT, AS WELL AS ANY OTHER SPECIFIC TERMS AND CONDITIONS APPLICABLE, AS REFERRED TO IN THIS AGREEMENT.
3. POLICY FOR THE PURCHASE OF ONLINE NUTRITIONAL ADVICE PACKAGES:
The user will access the Online Advice section and opt for one or more of the Nutrition Advice Packages.
To place an Order , The User will access the https://clinicadenutritie.ro/en/consiliere-online-2/ and will fill in the online form regarding the appointment consultation. To complete the Order, the User will have to make the payment through the online payment platform.
After doing so, The user will receive a confirmation email from the Nutrition Clinic. Within 2 business days of receiving the Order confirmation message, the Recipient will be called to schedule an online nutrition consultation.

The Nutrition Clinic undertakes to deliver Online Services on the Romanian and international territory, on the platforms established by Whatsapp, Zoom or Skype. The online nutrition advice packages and the information on the Packages can be modified at any time by the Nutrition Clinic.
The effective access of the nutritional counseling medical services is achieved by scheduling them through the reception of the Nutrition Clinic, within the available limits and intervals.
User assumes the correctness and accuracy of the data provided, including his or her contact details and those of Beneficiaries .
4. NUTRITION SERVICES PRICE AND ONLINE PAYMENT METHOD:
The payment related to the online counseling packages ordered through the clinicadenutritie.ro platform can be made through the online platform as well as by bank transfer. More details regarding the bank details can be requested at the e-mail address: cmdnutritie@gmail.com
All rates related to Packages are expressed in lei (RON) and are displayed in the Online Advice section.
The Nutrition Clinic does not charge any additional fees for online payments.
If the card is associated with an account in a currency other than RON, the transactions are made in lei, at the exchange rate of the issuing bank for the respective card.
In the case of online payments, Nutrition Clinic is not / cannot be held responsible for any additional costs incurred by User , including but not limited to currency conversion fees. applied by the issuing bank of its card, if its issuing currency differs from RON. Only User is responsible for this action.
Through the clinicadenutritie.ro platform, online payment can be made with a personal or company card, in full security conditions. The cards accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD, MAESTRO, if they have CVV2 / CVC2 code.
To successfully complete the transaction, the data required to authorize the transaction must be entered in the payment platform BT Pay .
Card data is processed exclusively through the BT Pay payment platform. Nutrition Clinic does not ask for or store any details about your card and will never ask for your card’s PIN.
To ensure the security of transactions, the Nutrition Clinic uses the BT Pay platform.
The Nutrition Clinic has taken all necessary measures to ensure the security of your data, but the transmission of data and information is the sole responsibility of the User .
The data entered for generating orders, except those related to the bank card (card number, expiration date, etc.) will be used only in accordance with the procedures of the Nutrition Clinic, in order to prevent any unauthorized access.
By sending Order , Buyer agrees to receive invoices by e-mail to the e-mail address listed in Order .
SINCE THE USER CAN ORDER THE DESIRED SERVICES AND INDIVIDUALLY THROUGH MONTHLY PROGRAMS WITHTHE POSSIBILITY OF BEING EXTENDED ON REQUEST, BY THE MEANS AVAILABLE BY CLINICA SRL, NOT ACCESSING ALL SERVICES IN THE PACKAGE, FOR NON-IMPUTABLE REASONS CLINICA SRL, DOES NOT CONFER THE RIGHT
5. RIGHT OF WITHDRAWAL
The user has the right according to the provisions of GEO 34/2014 to notify in writing Nutrition Clinic that he renounces the purchase of the online Nutrition Counseling Package, without penalties and without invoking any reason, within 14 working days from the date of receipt by the User of the confirmation message regarding the receipt of the Order .
RETURN REQUEST. The user must send from the e-mail address with which he registered on this site to the address cmdnutritie@gmail.com which must contain the explicit request for return, the identification data of the User , the identification data of the order, the bank account of the User in which the amount is to be returned and the branch where the account is opened.
In the event that the user renounces the purchase of the nutrition service according to this clause, the Nutrition Clinic will no longer provide that service.
SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL IS NOT ENSURED
The following are exempt from the right to withdraw from Contract :
- service contracts, after the start of the provision of the services in the contracted package, if the execution started with the prior express consent of the User and after he has confirmed that he has become aware that he will lose the right of withdrawal after the Seller has initiated the execution of the Contract .
6. FORCE MAJEURE
Neither party shall be liable for the failure to perform on time and / or for the improper performance – in whole or in part – of any obligation under this contract, if the non-performance or improper performance of that obligation was caused by force majeure, as is defined by law.
The party invoking force majeure is obliged to notify the other party, within 48 hours, of the occurrence of the event and to take all possible measures to limit its consequences, namely the presentation of alternatives.
If within 5 days from the occurrence, the respective event does not cease, the parties have the right to notify the full termination of the contract without any of them claiming damages.
7. APPLICABLE LAW:
The law applicable to legal relationships generated by accessing the Online Counseling Services of the Nutrition Clinic is Romanian law.
